These Terms and Conditions ("Terms") govern your use of all games, applications and services (collectively, the "Services") provided by BingWa Bit ("we", "us", or "our"). By accessing or playing any of our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Eligibility

Our Services are suitable for all ages. You must be at least 13 years old to use our Services. If you are between 13 and 17 years old, you may only use our Services with the involvement and consent of a parent or legal guardian. Users under the age of digital consent in their jurisdiction (16 in most EU countries) must obtain parental consent.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use our Services for personal, non-commercial entertainment purposes only. You may not:

• Copy, modify, reverse-engineer, decompile, or disassemble our Services.
• Rent, lease, sell, sublicense, or distribute our Services.
• Remove or alter any copyright or proprietary notices.
• Use our Services in any way that infringes our intellectual property or that of any third party.
• Use our Services to advertise, solicit, or transmit any commercial advertisements or solicitations.

3. User Conduct

You agree not to:

• Use cheats, exploits, automation tools, bots, hacks, or modifications to gain an unfair advantage in any of our Services.
• Attempt to access or interfere with the systems, servers, or backend infrastructure of our Services.
• Use our Services to harass, threaten, harm, impersonate, or defame others.
• Use our Services for any illegal purpose or in violation of any applicable law.
• Distribute viruses, malware, or any harmful code through or in connection with our Services.

We reserve the right to suspend or terminate your access to our Services at our discretion if you violate these rules.

4. Ownership

All rights, title and interest in and to our Services — including but not limited to characters, artwork, audio, code, gameplay design, level design, trademarks, and any other intellectual property — are owned by BingWa Bit or our licensors. These Terms do not grant you any rights to our trademarks, trade dress, or other intellectual property.

You shall have no ownership or property interest in any game account, virtual items, virtual currency, or game progress associated with our Services.

5. Virtual Items and Currency

Our Services may contain virtual items, virtual currency, lives, power-ups and other in-game elements (collectively, "Virtual Items"). Virtual Items:

• Have no real-world monetary value.
• Cannot be exchanged for cash, goods, or services outside of our Services.
• Are licensed to you, not sold, and remain under our control.
• May be modified, removed, reset, or expired at any time without notice and without compensation.
• Are non-refundable, even if our Services or your access to them is terminated.

If a specific game includes in-app purchases, additional terms regarding billing and refunds will apply and will be presented at the time of purchase. Payments are processed by Google Play; refund requests must be directed to Google Play as they handle the transaction.

6. Game Progress

Your game progress is stored locally on your device. We do not maintain a server-side copy of your progress. If you uninstall a game, clear its data, or switch devices, your progress may be lost. We are not responsible for any loss of game progress.

7. Advertising

Some of our games display advertisements provided by third-party advertising networks such as Google AdMob. Advertising features may include rewarded video ads (voluntary — you choose whether to watch), interstitial ads (shown between gameplay sessions), and banner ads. Interaction with third-party advertisements is subject to the terms and privacy policies of the respective advertising provider.

Whether a specific game includes advertising is disclosed on its Google Play listing.

8. Termination

You may stop using our Services at any time by uninstalling them. We may suspend, restrict, or terminate the Services (or your access to them) at any time, for any reason, including but not limited to violation of these Terms, suspected illegal or fraudulent activity, security concerns, or discontinuation of the Services. Upon termination, your right to use our Services ends, and we shall have no liability to you for any termination.

9. Service Updates

We may update, modify, or discontinue our Services (or any part of them) at any time, with or without notice. You may also need to install third-party software updates (such as operating system updates) from time to time to continue using our Services.

10. Disclaimer of Warranties

Our Services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, error-free, secure, or free of harmful components. Nothing in these Terms affects any statutory consumer rights that cannot be waived by agreement.

11. Limitation of Liability

To the maximum extent permitted by law, BingWa Bit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, including but not limited to loss of game progress, virtual items, data, or revenue. Our total aggregate liability for any claims relating to our Services shall not exceed the amount you have paid us in the six (6) months preceding the claim. For free Services, your sole remedy is to stop using them and uninstall.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of Spain, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sevilla, Spain. Before initiating any legal action, we encourage you to contact us at the address below so we can attempt to resolve the issue informally.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates the latest version. Your continued use of our Services after any update constitutes acceptance of the revised Terms.
